All sales are on a cash basis unless credit has been approved prior to pick up or delivery of material. Approved accounts are due in 30 days from date of invoice, with a 1.5% per month interest charge on past due accounts. Failure to pay all charges due will result in credit privileges being revoked. Any account over 30 days must be paid in full prior to additional purchases being made. All purchases made by check must also include the principal's name, home address, driver's license number, and date of birth.
PRICES AND DEPOSIT
Prices are for the wholesale trade only and subject to change without notice. You can reserve your material with a 10% deposit. Another 40% is due at harvest (3-4 weeks before delivery). Payment in full is due FOB. DELIVERY
Valley-wide delivery is available at a rate of $2.00 per mile one way. Payment is required prior to unloading material. Customer or representative must be present to accept material. Customer is to provide adequate equipment and personnel at customer's sole risk to unload material; driver is not responsible for unloading. Excessive waiting or unloading time will be billed at $30.00 per hour. We are happy to arrange trucking for orders outside the Rio Grande Valley.
PICK UP ORDERS
Orders to be picked up at our nursery require 3 days notice during the dormant season. Field stock to be dug during warm season will need 2-3 weeks curing time. Limited stock is available for same-day pick-up.
WARRANTY
Simmons Oak Farms, LLC gives no warranty, neither expressed nor implied. Trees are guaranteed to be healthy at time of shipment and true to name. Any claims should be made within 24 hours of receiving material. Liability is limited to the purchase price.
Purchasing material from Simmons Oak Farms, LLC constitutes acceptance of all terms and conditions stated.
